Terms of Use

These Terms of Use ("Terms") apply to the PromptSense application (the "Application") for desktop computers and mobile devices, created by NTWIND LLC ("NTWIND", "we", "us", or "Service Provider").

By downloading, installing, accessing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

1. License and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application for your personal or internal business use.

You may not copy, modify, sell, rent, lease, sublicense, distribute, or create derivative works based on the Application except as permitted by law or expressly authorized by us. You may not reverse engineer, decompile, disassemble, or attempt to extract the source code of the Application except to the extent applicable law allows despite this restriction. All intellectual property rights in the Application remain owned by NTWIND LLC or its licensors.

2. Accounts and Cloud Sync

PromptSense can be used without an account for local-only storage. Cloud sync and some Pro features require an account.

When you create an account or sign in with Apple or Google, you are responsible for keeping your account credentials secure and for activity under your account. Cloud sync stores your prompts, categories, and related metadata using our backend infrastructure, including Supabase and our self-hosted PowerSync service.

You may delete your account and associated synced data from within the Application settings. You may also request account deletion by contacting [email protected] from the email address associated with your account.

3. User Content

"User Content" means prompts, categories, text, and other content you create, import, store, sync, or export using the Application.

You retain ownership of your User Content. You grant us the limited right to process, transmit, store, back up, and display your User Content only as needed to provide, maintain, secure, and support the Application and cloud sync features.

You are responsible for your User Content and for ensuring that you have the rights needed to use it with the Application. You agree not to use the Application to store or transmit unlawful, infringing, harmful, abusive, or otherwise prohibited content.

4. Subscriptions and Paid Features

PromptSense offers premium functionality ("Pro Features") through monthly and yearly subscriptions. Available plans, prices, trial offers, and billing periods are shown before purchase and may vary by platform, country, currency, and store.

Apple App Store and Google Play

If you purchase through the Apple App Store or Google Play:

Apple and Google may have additional terms, refund rules, taxes, and payment requirements that apply to your purchase.

PayPro Global

For versions downloaded directly outside the Apple App Store and Google Play, subscriptions and payments may be handled by PayPro Global as our authorized reseller. PayPro Global's terms, renewal, cancellation, refund, and tax rules may apply to those purchases.

RevenueCat

We use RevenueCat to manage and validate subscription entitlements across supported platforms. Subscription access may depend on successful confirmation from the relevant store, reseller, and RevenueCat.

5. Third-Party Services

The Application uses third-party services, including Apple, Google, Supabase, PowerSync, RevenueCat, and PayPro Global. Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services, payment systems, outages, or changes outside our control.

6. Connectivity, Availability, and Updates

Some features require an active internet connection. You are responsible for internet access, data charges, device compatibility, and keeping your device and operating system secure.

We may update, modify, suspend, or discontinue any part of the Application or service at any time. We do not guarantee that the Application will always be available, error-free, uninterrupted, or compatible with every device or operating system version.

7. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and delete information. By using the Application, you agree to the Privacy Policy available at:

8. Termination

You may stop using the Application at any time. We may suspend or terminate access to the Application or cloud services if you violate these Terms, create risk or possible legal exposure for us, misuse the service, or where required by law.

Upon termination, the license granted to you ends and you must stop using the Application. Sections intended to survive termination, including intellectual property, subscription obligations, disclaimers, limitations of liability, and dispute-related provisions, will survive.

9. Disclaimer of Warranties

To the maximum extent permitted by law, the Application and related services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, NTWIND LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities arising from or related to your use of or inability to use the Application.

11. Apple-Specific Terms

For versions distributed through the Apple App Store, Apple is not responsible for the Application or its content. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms for Apple-distributed versions and may enforce these Terms against you as a third-party beneficiary. If these Terms conflict with Apple's applicable terms for Apple-distributed apps, Apple's terms control to the extent required by Apple.

12. Changes to These Terms

We may update these Terms from time to time. We will post updated Terms on this page and update the effective date. Your continued use of the Application after updated Terms are posted means you accept the updated Terms.
