Terms of Use

These Terms of Use ("Terms") apply to the Files Remote application (the "Application") for desktop computers and mobile devices, created by NTWIND LLC ("NTWIND", "we", "us", or "Service Provider").
By downloading, installing, accessing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.
1. License and Permitted Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application for your personal or internal business use.
You may not copy, modify, sell, rent, lease, sublicense, distribute, or create derivative works based on the Application except as permitted by law or expressly authorized by us. You may not reverse engineer, decompile, disassemble, or attempt to extract the source code of the Application except to the extent applicable law allows despite this restriction. All intellectual property rights in the Application remain owned by NTWIND LLC or its licensors.
2. Local Network, Shared Folders, and Pairing
Files Remote is intended to browse and manage folders on devices you own or are authorized to access. The Application works primarily over your local network or
Mac and Windows editions can host explicitly selected folders. Android and iOS editions can browse and manage folders made available by a Mac or Windows host but do not host their own folders. You are responsible for pairing only trusted devices, sharing only appropriate folders, and keeping your devices, operating-system accounts, local network, router, and firewall settings secure.
You may remove shared roots, delete paired devices, or change receiver-local Read and Write permissions in the Application where available. Removing a shared root from the Application does not delete the original folder.
3. Files, Transfers, and User Responsibility
Files Remote can list folders and file metadata, download and locally cache files, save or share received copies, upload selected files, create folders, rename items, move items to Trash or Recycle Bin, and permanently delete items when configured or confirmed. These actions may expose, copy, change, disclose, or permanently remove personal, confidential, copyrighted, sensitive, or otherwise protected content.
You are responsible for the folders, files, devices, transfer destinations, names, overwrite choices, and commands you use with the Application and for ensuring that every action is safe, authorized, and appropriate. You represent that you have the rights and permissions needed to access, process, transmit, copy, modify, share, or delete the selected content.
You agree not to use the Application to access, transfer, alter, delete, damage, disrupt, or interfere with devices, networks, accounts, data, files, services, or systems that you do not own or are not authorized to manage. You are responsible for reviewing the selected host, shared root, relative folder, file name, conflict choice, and deletion warning before confirming an operation.
4. Storage Providers and Third-Party Content
Files Remote does not provide cloud storage, hosted folders, file-library accounts, or content. The Application only helps you work with files available through your own devices, local network, operating-system file pickers, media libraries, and services.
You are responsible for filesystem permissions, shared-folder contents, local and network drives, cloud-backed files, Apple iCloud, Google Drive, Microsoft OneDrive, media libraries, destination apps, and any other provider you use. Third-party content and services may have their own terms, privacy policies, fees, restrictions, geographic availability, download behavior, retention rules, and technical requirements. Files Remote does not guarantee access to cloud-only, remotely stored, locked, or protected files.
5. Fees and Paid Features
Files Remote is currently provided as a free application. We may change how the Application or related services are offered in the future. Any charges, if introduced, will be communicated through the applicable app store, website, or Application interface before they apply.
If you obtained the Application through Apple App Store, Google Play, Microsoft Store, or another marketplace, your use may also be subject to that store's terms, privacy policy, billing rules, refund rules, taxes, and payment requirements.
6. Third-Party Services
The Application may be distributed through third-party app stores and platforms, including Apple, Google, and Microsoft. It may pass files to operating-system storage locations, Share sheets, media libraries, or destination apps when you request those actions. Third-party services may be governed by their own terms and privacy policies.
We are not responsible for third-party services, app store systems, payment systems, cloud-storage providers, destination apps, local or network filesystems, network services, outages, data loss, or changes outside our control.
7. Connectivity, Availability, and Updates
Remote features require network connectivity between your devices, and access to cloud-backed files may require internet connectivity on the device providing them. You are responsible for network access, data charges, device compatibility, file and media permissions, firewall and router configuration, available storage, source-file access, backups, and keeping your devices and operating systems secure.
Files Remote may not work if devices are on different networks, guest networks, isolated networks, VPNs, blocked by firewalls, or prevented from communicating by router or operating-system settings.
Browsing and file operations depend on the host device, operating system, filesystem, storage provider, folder permissions, file availability, available disk space, network performance, receiver capabilities, and system resource limits. Trash or Recycle Bin may be unavailable on some network shares, removable volumes, or filesystems. Open files, read-only storage, access controls, or provider behavior may prevent an operation.
We do not guarantee that every device, folder, file, transfer, rename, deletion, storage provider, destination app, or network will work in every configuration. You are responsible for maintaining backups of important data before granting Write access or performing file-management actions.
We may update, modify, suspend, or discontinue any part of the Application at any time. We do not guarantee that the Application will always be available, error-free, uninterrupted, or compatible with every device, operating-system version, storage provider, file type, file location, or network environment.
8. Privacy
Our Privacy Policy explains how we handle, use, share, retain, and delete information. By using the Application, you agree to the Privacy Policy available at:

9. Termination
You may stop using the Application at any time by uninstalling it or closing it where supported. We may suspend or terminate your right to use the Application if you violate these Terms, create risk or possible legal exposure for us, misuse the Application, or where required by law.
Upon termination, the license granted to you ends and you must stop using the Application. Sections intended to survive termination, including intellectual property, content responsibility, disclaimers, limitations of liability, and dispute-related provisions, will survive.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the Application is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, NTWIND LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, files, folders, goodwill, business opportunities, device availability, interrupted or failed transfers, overwritten content, renames, unavailable items, Trash or Recycle Bin behavior, permanent deletions, third-party services, or other losses arising from or related to your use of or inability to use the Application.
12. Apple-Specific Terms
For versions distributed through the Apple App Store, these Terms are between you and NTWIND LLC, not Apple. NTWIND LLC, not Apple, is solely responsible for the Application and its content, maintenance and support, product claims, and the investigation, defense, settlement, and discharge of any claim that the Application infringes a third party's intellectual property rights. Apple has no obligation to provide maintenance or support.
Your license for an Apple-distributed version is limited to use on Apple-branded products that you own or control and as permitted by the Apple Media Services Usage Rules, including applicable Family Sharing or volume-purchasing rules. If the Application fails to conform to an applicable warranty that has not been effectively disclaimed, you may notify Apple, and Apple may refund any purchase price paid for that Apple-distributed version. To the maximum extent permitted by law, Apple has no other warranty obligation.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms for Apple-distributed versions and may enforce these Terms against you as a third-party beneficiary. You must comply with applicable third-party terms when using the Application. If these Terms conflict with Apple's applicable terms for Apple-distributed apps, Apple's terms control to the extent required by Apple.
13. Changes to These Terms
We may update these Terms from time to time. We will post updated Terms on this page and update the effective date. Your continued use of the Application after updated Terms are posted means you accept the updated Terms.
